Blix Technology AB mobile app and service agreement including terms and conditions.
Please read these terms and conditions carefully.

Agreement terms

This rental agreement (“the rental agreement”) constitute a legally binding agreement made between you (the legal user) (“you”) and Blix Technology AB (“Blix”) (“we,” “us” or “our”), concerning your use of our battery rental service after registered an account in our Blix Batteries App.

1. General terms

You agreed to this agreement when select the checkbox before accessing your account, you have read, understood, and agree to be bound by all of these Terms and Conditions Use in the agreement. IF YOU DO NOT AGREE WITH THIS RENTAL AGREEMENT, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING OUR SERVICE AND YOU MUST DELETE YOUR ACCOUNT AND DISCONTINUE USE IMMEDIATELY.

The rental agreement are accessible on or in our App linked in to our website. We reserve the right, in our sole discretion, to make changes or modifications to the rental agreement at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of the rental agreement.

The information provided in our App is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to make an account in our App from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The App and our Services is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for a Blix Account.

2. Definitions

In this rental agreement the following words have below definitions:

User: The person that legally have an account in our App

Blix Batteries App or App: The App where the user are able to access our rental service.

Website: Refers to the URL;

User account: The account that our user issue when signing up in our Blix Batteries App.

Battery: The battery you can rent via our App

Services: The use of our App, website our rental service

3. User registration / User account

To get access to our services you are required to register an account in the app. You agree to keep your password confidential and will be responsible for all use of your account and password. You need to make sure you are the only user of your personal account. We reserve the right to remove, reclaim, or change a username you select if we determine. If someone else got access to your account you should contact Blix immediately.

3.1 User representations

By open a Blix account, you represent and warrant that:

1. All registration information you submit will be true, accurate, current, and complete

2. You will maintain the accuracy of such information and promptly update such registration information as necessary;]

3. You have the legal capacity and you agree to comply with these Terms of Use;

4. You are not under the age of 18

5. You will not access the Site through automated or non-human means, whether through a bot, script or otherwise;

6. You will not use the Site for any illegal or unauthorized purpose; and

7. Your use of the App and our service will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of our App and services.

4. Network access

To use our App you need to connect your device to a network. Blix do not take any responsibility about make sure you have stable network access. To make sure our App work smoothly you need stable network connection provided by telecommunications provider. Blix does not give any warranty of the performance refer to network connections.

5. Notifications

When creating your account you accept Blix to send notifications to you by email, phone our in the App.

6. Services

Blix shall provide you our services of battery rental trough our App. You will always be able to find, unlock a battery, use the battery and return it through our App. We can not guaranty that you always will find a battery stations any where at any time to rent/return, because we always will have limited pieces up and running. But we will make sure you can locate our rental/return stations via our map in our App and you will also be able to find opening hours for each rent/return station. Blix can not guaranty the battery level, it is up to the user to check.

7. Prices

The lock up and minute price may differ from city to city. You will always be able to find the current lock up price and minute price for all cities on our website and in our App.

Except from above prices Blix also have the following limits:

The maximum price per day (24hours) will be 50 SEK.

The maximum period of rent is 5 days, which means the total amount we charge you is 250 SEK for one rental time. If you do not return the battery after 5 days you have bought it and no more charges will be made.

All prices shown are included taxes.

7.1 Stolen and damaged

If the battery is damaged or stolen the user need to pay 300 SEK for the power bank. This will be paid in accordance with the payment methods in section 8.

8. Payment method

To pay our services we require a valid credit card or debit card. By providing your payment information, you authorise (A) Blix and our third part payment service provider, to send instructions to your bank to debit your account and (B) your bank to debit your account in accordance with those instructions. By providing your payment information you also authorise Blix and our third part payment service provider to save your payment information for future use of our services. The payment will be made when returning the battery in some of our stations or as mentioned in section 7 when reach 10 days of nonstop rental you will be charged the fees described in the Blix app or on our website. The payment process will be made by our authorized payment service provider and we do not take any responsibility of the payment process.

In order to dispute any fees charged by us you need to contact Blix Technology AB within a reasonable time. You find contact details in section 22.

9. Outstanding payment

Any outstanding payment of prices for the use of our services by you or any fee charged on the grounds of this Agreement we will make a series of attempt to debit your account the price by using the payment method described in Section 8. If they payment can not be made for any reason within your control for example wrong card digits Blix notice you about the time period you have to solve the problem. The service will automatically be disable in the meantime the payment pending.

If the payment still pending after series of attempt to debit the price or after one notice to the user including a period of time to solve the problem Blix have the right to invoice the customer by SMS or email provided in your Blix account. If the payment still pending after above methods Blix have the right to transfer the mission to a third part debt collection agency. Blix is entitled to charge the user for its own and third-party collection costs, insofar they were necessary for the relevant handling and are proportionate to the respective claim.

10. Free service

Blix work with free service in our marketing strategy. The free service will be based on email that will be registered for a manner of time to specific users. The user will be noticed from start or by email about the end date for the free service. Blix have the rights at any time to deactivate the free service for the user.

11. Force Majeure

All force majeure related troubles such as strikes, lockouts or lack of operating resources or raw materials that is out of Blix control shall not bring about a liability for Blix on account of failure to deliver the Services.

12. Conditions of the battery during rental period

While using Blix battery:

– Maintain and handle the battery with care

– Do not break or damage the battery or labels on it

– Keep away the battery from any water or fire

– The battery is your responsibility during the hole rental period

13. Returning the battery

While returning Blix battery:

– Make sure the battery are in the same condition when return it

– Make sure you return it right in some of our Blix stations- find help how to return it in the App

– In case the user does not return it in the same condition or the battery is stolen the user need to pay for the battery, the price refers in section 7.1.

14. Accident

In case the user is involved in an accident the user should contact the police immediately if necessary and inform Blix about the accident as soon as possible.

The user assume responsibility of an accident if he or she can be blamed for it.The assumed responsibility shall in any case include the obligation to repair the damages and the compensation of losses caused to third parties. The payment can be made via the payment methods configured in the user account or in accordance to payment methods in section 8.

15. Intellectual property rights

Unless otherwise indicated, the website and our App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws in Sweden, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the website our in the App “AS IS” for your information and personal use only. Except as expressly provided in the rental agreement, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

16. Complains and claims

All complaints or claims related to Blix and our services should be written to some of the options in section 22.

17. Modifications and interruptions

We cannot guarantee the App and our services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the App, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the App at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the App during any downtime or discontinuance of the App. Nothing in these agreement will be construed to obligate us to maintain and support the App or to supply any corrections, updates, or releases in connection therewith.

18. Duration and termination of the agreement contract

This agreement remain in full force and effect between you and Blix when create an account in our App. The contract can be canceled by either part at any time. If there is an ongoing rent when cancel the contract this agreement will be in force during the ongoing rent.

You can cancel they agreement by delete your account or by a written notice to some of the option in section 22.

19. Privacy Policy

All process of any personal data will be proceed in accordance with our privacy policy available on our website or by link in our App.

20. Applicable law and dispute resolution

This agreement are governed by and construed in accordance with the laws of Sweden. Any dispute related to our App or website will be settled by the district court in Sweden in accordance with the laws of Sweden.

21. Changes

We may update this rental agreement at any time. Blix will notify you via email or notification in the App. The user need to accept the changes before use our service again.
